1. About these terms
This website is operated by The Hamperville ("we", "us", "our"), 704 228th Ave NE #3017, Sammamish, WA 98074, United States. By visiting thehamperville.com or buying from us, you agree to these Terms of Service, our Privacy Policy, Shipping Policy and Refund and Returns Policy. If you do not agree, please do not use the site.
2. Eligibility
You must be at least 18 years old, or have a parent or guardian's permission, to place an order.
3. Products and descriptions
Our candles and hampers are handmade, so small variations in color, shape, texture and fragrance strength are normal and are part of their charm. We work hard to show colors and products accurately, but your screen may display them differently. Hamper contents may be substituted with items of equal or greater value if something is unavailable. We will tell you if a substitution significantly changes your order.
4. Pricing and payment
Prices are in US dollars and exclude shipping and applicable sales tax, which are shown at checkout. We may change prices at any time. If we find a pricing or listing error after you order, we may cancel the order and refund you in full. Payment is processed securely by Shopify and its payment partners, and we do not store your full card details.
5. Orders and acceptance
An order confirmation email is not an acceptance of your order. We may decline or cancel an order for reasons such as stock issues, suspected fraud or errors, and we will refund you if we do. We may limit quantities per customer.
6. Custom and personalized orders
For custom hampers, personalized notes or bulk orders, you are responsible for the accuracy of names, text and details you give us. Custom items are made to order, so they are not returnable except where they arrive damaged or incorrect. Changes can be requested within 6 hours of ordering. After that we cannot guarantee them.
7. Shipping, returns and refunds
Shipping and delivery are governed by our Shipping Policy, and returns and refunds by our Refund and Returns Policy. Risk of loss passes to you when the carrier delivers the order to the address you provided.
8. Candle safety
Candles involve an open flame. You agree to follow the burning instructions on our Candle Care and Safety page and to never leave a burning candle unattended or within reach of children and pets. To the fullest extent allowed by law, we are not liable for harm caused by misuse of a candle.
9. Allergies and fragrance
Our candles are scented with fragrance oils and may not suit everyone, including people with sensitivities, asthma or allergies. Please review each product's scent notes before buying. If you are pregnant, or have a medical condition or a pet that may be sensitive, consult a professional first.
10. Promotions and discount codes
Promotions, including free-shipping offers, run for the dates shown, cannot be combined unless we say so, and have no cash value. We can end a promotion at any time.
11. Intellectual property
All text, photographs, logos, product designs and other content on this site belong to The Hamperville or its licensors. You may not copy, reproduce or use them for commercial purposes without our written permission.
12. Acceptable use
You agree not to use the site for anything unlawful, to interfere with its security or operation, to submit false information, or to attempt to access accounts or data that are not yours.
13. Third-party links and services
The site may link to other websites and rely on services such as Shopify, payment processors and carriers. We do not control and are not responsible for third-party sites or services.
14. Disclaimer of warranties
The site and products are provided "as is" and "as available" to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted or error-free.
15. Limitation of liability
To the fullest extent permitted by law, The Hamperville will not be liable for indirect, incidental, special or consequential damages. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these terms limits rights you have under law that cannot be waived.
16. Indemnification
You agree to hold The Hamperville harmless from claims arising from your breach of these terms or your misuse of our products or site.
17. Governing law and disputes
These terms are governed by the laws of the State of Washington, without regard to conflict of law rules.
18. Changes to these terms
We may update these terms from time to time. The version posted on this page, with its "last updated" date, applies to your use of the site. Orders are governed by the terms in effect when you placed them.
